Re: TAS Appeal Reference Number BE/6784/19/45/O

Many thanks for spending time with me last Friday afternoon at Cleaver House to discuss my Pension Credits appeal.

As I think I may have already explained to you, there is a real risk -- as I see the situation -- that I might have to deal with another eviction attempt later this year, if my appeal is unsuccessful; or, if the appeal business drags on for too long before being finalised.

Attached please find a copy of the Repossession Order handed to me by Enforcement Officer Gerard Adair on January 11th last. Although I managed to avoid eviction on that particular occasion (just about as far as I can judge), doing so did mean that I had to pay out (in total) £18,147:10 during recent months: in order to cover rent arrears debt, Radius Housing Association legal fees, and the legal fees of the Enforcement of Judgements Office. One of a number of issues that has puzzled me about all of this, is that Radius Housing Association (and Babingtons Solicitors, BT47 6JU, the law firm acting on behalf of Radius), the Courts, and the Enforcements of Judgements Office, all seem (to me) to have pre-judged the outcome of my Pension Credits appeal hearing: which has not yet been finalised. While accepting that it may have been lawful for them to do so, I nevertheless struggle a little at times to understand how it can be?

It was only possible for me to pay the £18,147:10 in question because of the fact I had earlier, over a period of several years, borrowed a total of approximately Euros 116,000 from my brother (Gerald Finnerty) and my late half-sister (Marjorie Dolan) against my home in New Inn village, County Galway, Republic of Ireland: none of which has yet been paid back. For no good reason known to me, Patrick Hogan & Co (law firm based in Ballinasloe, County Galway) refused to secure the loans in question against my home, when requested to do so by my brother and half sister sometime around late 2006 or early 2007, which is when the monthly loans to me against my home in New Inn began, and all of which were paid to me via my AIB bank account in Ballinasloe. The monthly loans to me in question ended in July 2021.

I hope you will be able to take on my case. If for any reason you cannot though, I would be very grateful to you if you could please let me have confirmation of this as soon as you reasonably can.

Kind regards,

Billy Finnerty.
