Dear Mr Kerr-Johnson,
Re: Self, and May 18th 2021 "Order of Possession" for Radius Housing Flat I am staying in
In connection with legal difficulties I am experiencing, your name has been
indirectly passed on to me by people associated with Extern
Homes, and with the Belfast Health and Social Care Trust.
The most pressing of these difficulties for me just now relates to the
fact that I have recently received a letter (dated May 18th 2021) from
Ms Michelle Bresland (Solicitor) at Babington Solicitors, who are acting
on behalf of Radius Housing Association, informing me -- among other
things -- that
"The Order for Possession terminates your secure
tenancy with our client and you are now required to vacate the property,
remove all belongings and return keys to our client without delay."
A scanned copy of the May 18th 2021 letter in question from Babingtons
Solicitors can be viewed at the following www location:
http://www.humanrightsireland.com/BabingtonsSolicitors/18May2021/LetterFromBabbingtonsSolicitors.htm
As the letter referred to at the www location immediately above
contains no mention of the possibility of appealing the court decision
made on May 18th 2021, I sent an email to Ms Bresland last Friday (May
21st) which contained the following piece of text:
"The main reason I am writing to you just now is because I would like to
know if it is possible for me to appeal the decisions made by the
Belfast District Court
Judge referred to in your May 18th 2021 letter to me?".
A slightly edited copy of the full email I sent to Ms Bresland last
Friday (May 21st 2021) can be viewed at:
http://www.humanrightsireland.com/BabingtonsSolicitors/21May2021/Gmail.html
An unedited "Gmail PDF"" copy of last Friday's email to Ms Bresland has
also been placed at:
http://www.humanrightsireland.com/BabingtonsSolicitors/21May2021/Gmail.pdf
I also sent a signed printout of the May 21st 2021 email referred to
above through the registered post to Ms Bresland on Friday last, which
according to the Royal Mail Postal Service was successfully delivered
yesterday morning at 8:39 am.
In addition, I sent a signed printout of the May 21st 2021 email
referred to above through the registered post to the
Officer in
Charge at Laganside Courts (Civil Section) on Friday last, which
according to the Royal Mail Postal Service was successfully delivered
yesterday morning at 8:28 am.
So far I have not received any reply of any kind from anybody connected
with Babingtons Solicitors, or with Laganside Courts, to the May 21st
2021 email, and the two closely related registered letters referred to
above.
It would be much appreciated if you could please help me regarding the matter
of whether, or not, you believe I would be entitled to appeal the May
18th 2021 "Order of Possession"?; and, if so, the time limit within which
I would need to lodge the appeal?
Also, a local person I know has suggested to me this morning that -- in
their view, and allowing for the "Order of Possession" which Radius
Housing were granted on May 18th 2021 -- Radius Housing Association
would probably now be within their legal rights to, among other things,
have the lock changed in the front door to the flat I am still living
in, while I am out shopping for example? I would also be very
grateful to you for any legal advice you might be able to provide me with regarding
this particular "changing the front door lock" matter please, which,
if true, I
find very worrying.
Yours sincerely,
William Finnerty.
