TDs (MPs) UPDATE OF OCTOBER 27TH 2015: "SEEKING ASYLUM IN THE
UK”
An email was sent last week (Friday, October 23rd 2015) to the Secretary-General
of the United Nations (Ban Ki-moon) on the subject of "seeking asylum in the UK
(United Kingdom of Great Britain and Northern Ireland)".
It was the eight in a "set of eight emails" sent since the end of July 2015;
and, like all of the others, it was copied to several other people and
organisations, using the SAME email. The full "set of eight emails" is listed
below, towards the end of the text below.
The text contained in the sections below is very similar to that used in
the October 23rd 2015 email referred to above.
A copy of the FULL email sent to the UN on October 23rd 2015, which contains all
of the message-text and both of the recipient lists, can be viewed by clicking
on the following www link:

Dear Sir / Madam,
RE: REQUEST FOR MORE INFORMATION (via A64A SOCIAL SECURITY FORM)
Attached please find the completed A64A Form.
With reference to the sections of the A64A Form referred to below by number, I
wish you to know the following:
===
Section 1 of this letter, REFERENCE SECTION 5 (of attached Social Security A64A
Form):
a) As far as I know, there is an extant warrant for my arrest in the Republic of
Ireland, which was issued on July 8th 2015; and, I feel I cannot sensibly or
safely return to the Republic of Ireland because of it.
b) I have sent a registered letter to the Clerk of the Court involved, and to
the Presiding Judge Geoffrey Browne, on July 9th 2015, in which I pointed out
(among other things) that I would like to challenge the legality of the warrant
in question. A scanned copy of the registered letter in question, together with
scanned copies of the associated Post Office receipt, and the "Proof of
delivery" note, can be viewed at the following www location:
http://www.humanrightsireland.com/LoughreaDistrictCourt/9July2015/ScannedRegisteredLetter.pdf
In addition, there is an email version of the registered letter in question
(also sent on July 9th 2015) available for viewing at:
http://www.humanrightsireland.com/LoughreaDistrictCourt/9July2015/Email.htm
To date, I have not received any reply of any kind to the registered letter and
the email to Loughrea District Court referred to above.
Although I am trying to find legal representation of the kind that would help me
to challenge the legality of the warrant for my arrest issued on July 8th 2015,
I still have not found any.
Some general information relating to the background to my case, which was taken
by hand by my brother (Gerald Finnerty) and my half-sister (Marjorie Dolan) on
April 15th 2015 to lawyer Brendan Glynn (of Patrick Hogan & Company, Dunlo
Street, Ballinasloe, County Galway, Republic of Ireland), can be viewed at the
following www location:
http://www.humanrightsireland.com/LawyerBrendanGlynn/15April2015/Letter.pdf
Unfortunately, lawyer Brendan Glynn, and his lawyer colleagues at law firm
Patrick Hogan & Company, continue -- from my viewpoint at least -- to completely
ignore the entire contents of the April 15th 2015 letter referred to just above,
and to act as though they never knew anything whatsoever about any of it.
It is also the case that lawyer Brendan Glynn failed to turn up in Loughrea
District Court on July 8th 2015, the day the warrant for my arrest was issued:
so that I had no legal representation of any kind at all in court on that day.
===
Section 2 of this letter, REFERENCE SECTION 7 (of Social Security A64A Form):
The "St Albans" property was gifted to me by my mother in the 1970's, and she
was the legal owner of the property at the time she gifted it to me.
Consequently, I never had a mortgage on the property. The legal transfer of the
"St Albans" property from my mother to me, was implemented by law firm Patrick
Hogan and Company (referred to above).
Since 2007 however, I have borrowed a total of approximately Euros 65,000 from
my brother and half-sister against my home ("St Albans") in New Inn,
Ballinasloe, County Galway, Republic of Ireland. Written evidence of this loan
can be viewed in the original of the letter I have received from my half-sister
and brother dated September 9th 2015, which I am enclosing as part of this
letter, on the understanding that the original will be returned to me.
An electronic copy of the above mentioned September 9th 2015 letter, together
with a closely related "To Whom It may Concern" letter dated September 15th
2015, which was written by me, can also be viewed at the following www location:
http://www.humanrightsireland.com/GeraldFinnerty/9September2015/Letter.pdf
Meanwhile, I feel I should point out that, in connection with an application I
have made for "Housing Benefit" some months ago, I have been advised in a letter
dated October 1st 2015 from Housing Benefit Manager Gail Forbes (copy attached)
that "only secured loans can be deducted", and that consequently I "do not
qualify for Housing Benefit".
Some days ago, I was advised by a local Newry-based lawyer that, assuming I
understood the lawyer in question correctly, it would probably be a relatively
simple matter (in my particular circumstances and those of my brother and
half-sister) to have the above mentioned loans "legally secured", in a formal
way, against my home ("St Albans") in the Republic of Ireland; and, at the
present time, I am waiting for further written information regarding this matter
(from the Newry-based lawyer in question).
Also, the copy of a closely related registered letter sent by me to South Area
Housing Benefit Manager Mrs P. Cartmill (dated September 17th 2015) can be
viewed at the following www location.
http://www.humanrightsireland.com/CraigavonHousingBenefitUnit/23September2015/Letter.htm
===
Section 3 of this letter, REFERENCE SECTION 13 (of Social Security A64A Form):
There are water charges, but I am unable to remember what the sums or the dates
of payment involved are, on account of I not being in the Republic of Ireland at
the present time, and consequently not having access to my papers there.
===
Section 4 of this letter, REFERENCE SECTION 26 (of Social Security A64A Form):
Allowing for the fact that I owe my brother and my half-sister a total of
approximately Euros 65,000 against my home ("St Albans") -- and that the
property has recently been valued at Euros 35,000 -- my financial interest in
the "St Albans" property is nil at the present time.
I enclose the original of a Valuation Report dated September 8th 2015 for the
"St Albans" property, on the understanding that it will be returned to me: which
states that the "Total Valuation" of the property is Euros 35,000.
However, if it becomes possible for me to be paid the sums I am owed by the
Republic of Ireland's Government for the old the age pension I should have been
receiving since March 2011, and for the outstanding disability payments I am
owed since before March 2011, I would be able to pay back much of the money I
now owe to my brother and half-sister, and, at the same time, have the property
restored in a way that allows me to live in it.
Allowing for the overall contents of the set of four registered letters referred
to at the two www addresses provided just below, all four of which included
copies of Dr Michael McCavert's (my former GP) "To Whom It May Concern" dated
October 28th 2005, there is no good reason whatsoever (that I know of) for the
ongoing non-payment of the old age pension and disability payments referred to
above (up to July 8th 2015):
http://www.humanrightsireland.com/SWSO/Longford/Letter16March2011.htm#Minister_Joan_Burton_TD
http://www.humanrightsireland.com/PensionAppealsOfficer/2November2011/RegisteredLetter.htm#President_Michael_D_Higgins
I continue to seek legal help for the purpose of trying to ensure that I am paid
the money that I am at present owed by the Republic of Ireland Government in
connection with the unpaid old age pension and disability sums referred to
above: which I estimate come to approximately Euros 60,000 in total.
===
Should you require any further information from me regarding my "Pension Credit"
application, or any of the associated issues, please let me know.
Yours sincerely,
William Finnerty.
